Pre-Contract
• Prepare letters of acceptance (in accordance with E-tendering portal Tejari), tender documents. Ensure conformance by contractors to the standard Conditions of Contract (CoC) and consultants to standard consultancy agreement, liaise and clarify matters with the legal dept. for any proposed deviations raised by contractors or consultants to the standard terms and propose contractual terms to the acceptance of both parties.
• Advise procurement and development team, cost consultants on the standard forms of CoC to be incorporated in a particular tender considering involvement of trust agent and role of Engineer, PM+SC.
• Advise on contractual matters relating to liquidated damages, retention, variations, insurances and all contract administration matters.
• Advise development team on the standard schedules 1 to 8 to be used for different consultancy agreements i.e. masterplanning, concept design, design & supervision, QS, PM consultancy.

Post-Contract
• • Prepare contract documents and consultancy agreements. Draft contractual correspondences to contractors and consultants pursuant to the terms of contract and consultancy agreements.
• Administration of advance payment, performance and retention bonds based on IPC and FC certified by consultants. Prepare settlement Agreements, novation Agreements, assignment and secondment Agreements.
• Assist in review of Contractor’s claims and Engineer’s assessment for extension of time (EOT) matters including the chronology of events to ascertain the legitimacy of Contractor’s entitlement to cost and time in accordance with the Contract.
• Assist in evaluation of project schedules and records to determine cause, effect and liability for construction delay and/or disruption.
• Assist in drafting the delay analysis narrative and EOT determination letters to the contractor’s agreements.

Pre-Contract
• Develop and implement procedures for contract management and administration in compliance with company policy as appropriate. Contribute to and influence company policies on contractual matters. Ensure that all contractual procedures are implemented and maintained. Advise on all contractual matters.
• Responsible for negotiating the terms and conditions of contracts (i.e. particular Conditions of Contract (CoC) Part II and LOA) and ensuring compliance with the terms and conditions during the Contract administration phase, as well as documenting and agreeing on any changes or amendments that may arise during the Contract period. Provide guidance and assistance to Project Management Team (PMT) on all contractual matters.
• Liaise with other departments to collate information required for the preparation of letter of acceptance, consultancy services agreements, amendments to contract/agreement.
• Conduct pre-bid and post bid clarification meetings with Contractors/Consultants for reaching amicable terms in the Contract(s) acceptable to parties with minimal risks to the company.
• Draft Volume 1 (tender and contract conditions) for tender documents for construction work packages (i.e. enabling works, main works, MEP works, ID works etc.) prior to issuing for tender to the contractors/ subcontractors.
• Review request for fee proposal for consultancy services (lead consultancy services, ID design, project management services) prepared by Technical Dept/Commercial Dept and finalize prior to issuing for tender.
• Prepare letter of nomination for ID, Carpentry and Joinery, Aluminium and Glazing, MEP works, sanitary, light fittings, tiles packages to be issued to consultant(s) to instruct the contractor(s) accordingly for the nominated suppliers/subcontractors.
• For smaller work packages and consultancy services:
a) Liaise with Commercial Department to advise on the appropriate work order format (from a list of standard work order formats) for use in tender depending on the type of work or services to be carried out/performed.
b) Assist Commercial Department to negotiate with the tenderers on the contractual terms and conditions of the work orders/ purchase orders.
c) Prepare work orders/ purchase orders to the selected contractors or consultants in conjunction with Commercial Department and Technical Department to ensure that all commercial and technical terms are clearly incorporated in the work orders.

Post-Contract
• Draft amendments to contractual documents as required.
• Draft contractual correspondences to contractors, consultants and maintain records to ensure the effective administration of the Contract(s).
• Review and respond to contractors claims on contractual matters in accordance with the provisions of the CoC and ensure the company’s interests are protected. Advise on commercial implications of change orders.

• Handled Planning and Procurement function for 11 Projects in Abu Dhabi and 4 Projects in Dubai. Reporting to the General Manager - Procurement, M&E Div. I was assigned to manage the Procurement of all these projects costing AED 2.14 Billion. Responsible for procurement of MEP equipments

• Verified the quotations in accordance with schedule and technical specifications. Prepared Techno commercial Comparison and finalized the subcontractors /material based on Technical compliance, Prices, best Delivery and Credit terms.

Concluded the deal and obtained award acceptance from the bidder. Prepared contract terms, conditions and commercial schedules.
