Job Description and responsibilities are divided into two stages:
• Tender, Pre-award stage responsibilities;
1- Responsible for preparing / review various contracts / agreements (drafting, evaluation, negotiation and execution) including short forms and Construction Contracts (FIDIC or Adhoc Contracts conditions).
2- Review the tender documents and prepare a report highlighting the risk and opportunities in the Contract Documents.
3- Communicate and discuss my comments to all relevant departments and top management to enable taking of proper decision, and ensure the proper awareness of all conditions that may affect the pricing, preparation of technical offer and issuance of relevant bank guarantees and insurance policies.
4- Prepare the contractual clarifications to be submitted with the offer, follow up with client’s feedback regarding theses clarification.
5- Conduct the all negotiations till reaching the final agreed draft of the contract, and the signature.
o Post-award stage responsibilities.
1- Provide a definitive interpretation of obligations and rights to support the proper contract implementation; in addition to the involvement/ follow up in the issuance of the contractual bonds with the finance department.
2- Provide a guidance and written support on contractual matters to the project managers or other operational staff (i.e. drafting the contractual supporting letters and necessary amendments...Etc.),
3- Ensure the proper implementation of the contract regarding the time and budget constraints, and provide the necessary guidance and support to mitigate the impacts of any time/ cost variance. Advice on all contractual and financial matters of the project, reporting directly to Project Manager and assist him in overseeing the work progress and strategic decisions whilst being responsible of all commercial aspects and payments
4- Initiates and/or conducts meetings with contractors concerning contractual problems as requested by Construction Project Manager
5- Prepare acceleration agreements in case of delays not attributable to the Contractor.
6- Follow up and maintain the contractual records and correspondences of the projects in hand.
7- Highlight the Variations to the site team, review them, and negotiate with the Engineer/ Client,
8- Prepare and review the claims/ counter-claims in connection with the projects,
9- Follow up and maintain the proper contractual reports to the law firms in case of disputes, courts or arbitration.
10- Ensure the contract close-out (TOC, retention, LGs Etc.) in a proper and safely manner.
