Assessing quantum and relevance of the Main Contractor’s claims made against Eskom (Client). Emphasis being placed on claims in respect of Access, Force Majeure, Damage, Preservation and Design Changes (VO’s) from primarily Alstom, Mitsubishi-Hitachi, MPSJV etc. with a view to establishing the merit in counter claiming under the FIDIC Red and Yellow Books by establishing the culpable parties responsible for the causation of the claims, in the first instance.
Subsequent findings being highlighted and reported to the Forensic Planning and Legal Group, in order to establish the validity of a counter claim against those parties responsible, under the heading of ‘Employers Claims’(Ref:-Clause 2.5 FIDIC Yellow Book).
