Commercial & Contracts Manager AGC at Seconded to the AusGroup of companies

The AusGroup of companies operate in Australia and South East Asia providing a range of ‘onshore’ and ‘offshore’ construction and SMP fabrication (including complete pipe spooling, subsea module packages and port load-outs), site installation & Maintenance works, (as well as installation, scaffolding and insulation works via its subsidiaries and JVs), primarily to the Mining and O&G sectors.

With responsibility for the AGC Commercial Function and the first point of contact and owner for all AGC commercial activities, I supported the project delivery teams and reported directly to the Executive General and Group Commercial Managers. I performed the lead commercial role for all projects in the AGC/ Oil & Gas Division. My initial task was to set up a satellite offices in Kwinana and at Henderson port and develop a commercial dept. by building a team of like-minded and enthusiastic professionals. Once accomplished, our role was to provide systematic and consistent commercial governance, administer the contracts, provide business oriented legal solutions, proactive contract-related advice, as well as contractual and claims management support during the bid/ pre-contract, execution and close-out phases.
Summary of responsibilities and main duties included…
My primary role included leading a team of Contracts Managers, Contracts Engineers/ Quantity Surveyors, Procurement and estimating professionals & providing daily commercial and contract support and advice to maximise the financial effectiveness and profitability of the business through diligent application of proper contractual and commercial practices and with the careful management of risk. I was tasked with the management and development of the Commercial Services and Supply Chain teams encompassing all contractual, legal, risk and Procurement activities for the business line. (as well as temp. Project Controls Manager).

My primary responsibilities covers all aspects of the contracting process including -providing daily support to the project delivery team in the administration and management of the head contract, procurement, subcontract & cost management, Risk and Claims Management, managing and mentoring a team of Contracts Engineers/QSs and deputy contracts manager - whilst ensuring commercial governance with a commitment to health, safety and environment.

Whilst working at AGC, I feel my greatest achievements were….

1/The noted improvement in Commercial acumen within the project team, (understanding scope v variation, improvement in recording & notifications, introduction of ‘Change Management’ procedures and the development of procedures (e.g. introduction of cash flow forecast requirement prior to milestone payment regime agreement -improving our WIP position)

2/ Promotion of Co. values in dealing with colleagues and re-building client relationships and expectations during and following periods of high staff turnover and uncertainty in the market.

Representing the Client
Prior to relocating to WA, I was employed directly by the University representing the client’s interests. Initially as Principal C.O.W./
Client Representative, and progressively to carrying out the roles of Projects & Contracts Delivery Management, primarily for the
delivery of a c. €0.5B ‘Campus of the Future’ major Infrastructure development, which also included the maintenance and upgrade of
the existing ‘live’ campus and estate. My varied background and skills suited me perfectly to the role, as it was very diverse, requiring
