a) Post-Contract: Claims & Variation Orders

• Acting as the single point of contact for the PMC for claims and disputes and to manage the claims and dispute resolution process on behalf of the client.
• Pre-qualifying claims received from Contractors:
 Checking Contractors claims are received within contractual timescales.
 Checking Contractor has submitted reasonable initial substantiation of the claim.
 Advising whether Contractors claims are administratively compliant with the Contract.
 Notifying the Contractor as appropriate.
• Conducting forensic analysis of claims and potential claims:
 Reviewing contractor’s claims and potential claims.
 Liaising with project team to obtain relevant background information and documentation.
 Conducting forensic investigation of the technical construction issues.
 Undertaking delay analysis of the program critical path.
 Determining presence of Contractor-caused concurrent delay (if any).
 Formulating the client’s defense and/or counter-claim, as appropriate.
 Ascertaining Contractor’s entitlement, if any, in respect of change in scope, extension of time and financial quantum.
• Preparing claims reports:
 For each claim and potential claim on the claims register.
 To confirm claim is pre-qualified and administratively valid.
 To confirm results of forensic analysis of claims and potential claims.
 For presentation to direct manager for review, analysis and approval.
 For submission to the Engineer in due course for his consideration.
 To form the basis of summary presentations to key internal stakeholders.
• Negotiating and settling claims:
 Preparing all necessary letters and transmittals to be issued in respect of potential claims or claims
 Undertaking commercial negotiations with Contractors commercial team.
 Reaching provisional settlement with Contractor.
 Making settlement recommendations to key internal stakeholders.
 Obtaining all necessary approvals to authorize settlement.
 Preparing contract change notice and / or settlement agreement.
 Facilitating the avoidance and/or mitigation of successful Contractors claims and disputes.
• Preparing and maintaining a detailed register of Contractors claims and potential claims.

b) Pre-Contract and Post-Contract Provisional Sums Procurement and Contracts Management for MEP, Architectural Finishes and Utility Diversion Works

• Planning and executing pre-tender and pre-contract stages, including commercial evaluation of tenders received, ensuring the contracting strategies and the ultimate contracts developed are consistent with company approved policy.
• Preparation of the tender documents and offering advice as to contract selection and procurement route ensuring at all times that appropriate risk mitigation is undertaken.
• Responding to contractual tender queries as appropriate.
• Drafting and preparing the scope of works, BOQ’s and tender documentation, calling and evaluating the tenders, compiling and negotiating contracts with the main contractors.
• Advising management of contractual rights and obligations; compiling and analysing data; and maintaining historical information.
• Reviewing commercial and contractual evaluation including analysis of quoted rates and prices to reveal the pricing strategies adopted by various tenderers, contractual qualifications and their effect on the final contract cost and claims, financial strength and legal/commercial status of tenderers, etc.
• Attending pre-award meetings, clarifications and negotiations with bidders prior to contract award to resolve any pending matters prior to signature and finalization of the formal contract with the contractors.
• Evaluating and review the Provisional Sums and Architectural Finishes Procurement Schedule, Tender Plans, Invitation To Tender (ITT) documents and Contract Documents.
