• Coordinate with internal legal team, law firms, government authorities to resolve ongoing legal disputes.
• Evaluate contractual risks at the tender stage and advise chairman and senior management on the commercial viability of the Projects. Lead contract negotiations with the clients.
• Develop and implement procedures for contract management and administration in compliance with employer’s policy.
• Administer on going contracts, investigate issues and recommend corrective/mitigation measures to project managers.
• Prepare/review project correspondence and ensure contemporary records are maintained to substantiate claims for time and/or cost extension. Assist the Project Managers in the preparation of all financial and contractual correspondence.
• Ensure that the external changes are taken up with the clients on a timely basis.
• Liaise and negotiate with clients for settlement of variations/change orders and interim/final payment certificates.
• Actively participate in periodic meetings with project team/clients/consultants/vendors for all contractual and commercial matters on the Projects.
• Prepare and manage contractual claims arising on the Projects.
• Review and monitor subcontractor’s claims, variations, agreements as per the contractual provisions and Project budget.
• Manage final accounts including preparation, submission and agreement with client/contractor/consultant. Monitor bank guarantees and retention releases.
• Fully responsible for Subcontract Management on Projects worth AED 2.1 Billion.
• Perform contractual and commercial evaluations of subcontractor’s proposals and formulate recommendations.
• Lead negotiation meetings and prepare bespoke LOI/LOA/Subcontract and Supply Agreements for subcontractors/vendors.
• Monitor the performance of service providers on a regular basis and prepare change notices, variation orders /subcontract amendments as required.
• Evaluate subcontractor’s invoices and prepare subcontract payment certificates.
• Review contract and legal documents such as non-disclosure, consortium agreements.
• Responsible for detailed tender reviews and contractual risk assessment.
• Liaise with peers, internal departments to identify and define schedule of attendances, risk & liability, scope demarcation and responsibilities under the prime contract.
• Provide general assistance & advice on contractual & procurement matters to the project teams.
• Draft appropriate contractual correspondence to best serve and protect company’s interests.
• Assist contracts manager in administering subcontract and prime contract claims.
• Identify entitlements, collate critical information and documents to prepare claims/ counter-claims.
• Carry out evaluation of tender documents, contract conditions, specifications, drawings and prepare techno commercial proposals
• Monitor market developments to identify and exploit new business opportunities.
• Plan, write, co-ordinate and submit response to enquiries/ITT.
• Prepare initial assessment of the technical, financial, schedule risks associated with the bid/proposal.
• Liaise with clients during pre and post award stage of bid for technical discussion, commercial negotiation and contract finalization.
• Request for proposals, negotiate and prepare subcontract agreements for major items of awarded projects.
• Prepare ISO documentation and develop comparative assessment forms.
• Prepare contractual correspondence during pre and post contract phase.
• Formulate response during contractual & legal issues such as LD’s, termination, appeal.
• Negotiate revisions and changes in the contract agreements.
• Manage execution strategies and quality systems as per client’s requirements.
• Formulate site execution plan and manage daily site operations.
• Estimate material, construction, labor costs and project timescales.
• Supervise the manpower, materials, machinery, and methods of construction
• Estimate item wise material quantities for the forthcoming month and carry out monthly material reconciliation.
• Review subcontractor’s payment applications, prepare quantification for submission of monthly progressive invoices.
• Maintain project documentation and records as per company’s standards.
• Supervise construction works to ensure it complies with QA/QC and HSE requirements.
• Organize project meetings with clients, subcontractors for coordination and progress evaluation.
