General:
• Establishment and development of procedures and policies. • Identify opportunities to improve business processes. • Develop, audit and update standard forms • Prepare and negotiate different types of contractual agreements.
Tender / Pre-Contract Stages:
• assess and advice on new potential businesses opportunities. • Analyze and assess Tender Documents and provide Risk Registers. • Ensures all Tender Securities are in place.
Operation / Post-Contract Stage:
• Administration and Management of the Main Contracts and major Subcontract . • Prepare Risk Management Plan.
• contractual correspondences, Amendments, MoU, Settlements. • Advise peers on contractual matters. • communication with all stakeholders for all contractual matters. • Ensures warranties, bonds, insurances, guarantees, etc., are in place. • Change Requests and Variation Orders. • Observe Quality, HSE Policies and Procedures.
Subcontracting:
• Prepare Design Services Agreements and major Subcontract Agreements. • Negotiation of Subcontracts. • Evaluation of Subcontract changes and VO.
Claims, Disputes Avoidance and Resolution
• Proactively identify and mitigate potential conflicts. • Utilize strong negotiation skills and knowledge of contracts to avoid disputes and resolve issues before escalation. • Prepare narrative and merit reports of major claims. • Communicate, negotiate, appoint and manage outsourced consultants. • Review, assess and determine claims of major Subcontractors. • Manage the review of contractual notices of claims. • Liaise with the Legal Department for all legal requirements. • Support the Legal Department in all litigation and arbitration cases.
Closeout Stage
• Manage the contracts closeout procedures. • Recommendations for Release of Retention and Bonds to Subcontractors. • Liaise with the Commercial Department for the preparation of the Final Account under the Main Contracts and Subcontracts.
Responsibilities
• Assessment and recommendation of contractors’ claims.
• Management and resolution of contractual disputes.
• Prepare Projects’ correspondences, including contractual letters, Minutes of Meetings … etc.
• Review and certify the Contractor's Interim Payments.
• Manage the coordination process between the designers of different disciplines.
• Generate regular progress reports and other project-specific documentation, keeping employer(s) and other stakeholders informed of significant project developments.
• Review contractors’ civil and architectural technical submittals, including shop drawings, material samples, and technical data, for compliance with specifications and standards.
• Coordinate and lead regular meetings with contractors, client representatives, and other stakeholders to ensure timely and effective communication and collaboration.
• Conduct regular site visits to monitor construction progress to identify potential issues, hazards, and risks and ensure adherence to engineering standards and design documents.
• Ensure compliance with health and safety regulations and industry requirements while maintaining high levels of quality and transparency.
• Develop and maintain strong relationships with clients and other stakeholders, including contractors, sub-contractors, and regulatory bodies, to foster effective communication and collaboration.
