Project: monorail project. EPC turnkey Contract. The purpose of the Contract is the engineering, procurement, construction, testing, commissioning, putting into service of the East of Nile Monorail Transportation System with a length of 56.44 km and 22 stations and the West of Nile Monorail Transportation System with a length of 42 km and 12 stations, including one depot for each Monorail Transportation System line. Contract Price: Euro 2.7 billion.
Client: Ministry of Transport represented by the National Authority for Tunnels.

Contractor: Consortium comprises a Consortium (Bombardier Transportation UK and Bombardier Transportation Egypt) and a Joint Venture (Orascom and Arab Contractors Osman A. Osman & Co.)
Post Award Responsibilities:
• Identified and communicated any issues as well as actions taken to mitigate those issues;
• Responsible for adherence to all statutory compliances, laws and safety standards;
• Provided advice and support to the Project team on events likely to cause cost, delay or disruption;
• 20.1 Responses to Contractor’s claim related project records;

Assignment: assist OTV in its arbitration case against SEDAPAL pertaining to the HUACHIPA treatment plant and transmission pipeline in Lima, Peru.
Reviewed and assessed the strength and weaknesses of VWT’s claim against SEDAPAL.
Assessed the risks and opportunities of Veolia in case of arbitration against the client.
Prepared a roadmap to arbitration to guide OTV LATAM on the procedure of arbitration.
Drafted executive summary presenting the case with Veolia financial exposure.
Drafted Liability Assessment Memorandum for Veolia’s directors with recommendations on arbitration.
Finalized a Joint Defence Agreement with Camargo.
Drafted Request for Arbitration for initial filing (workgroup with “Rodrigo, Elias & Medrano”, OTV Peru’s Lawyers, DLA Piper, Camargo’s Lawyers, and Mayer Brown, VWT’s lawyers);
Drafted Heads of Claims (workgroup).
Project: Medupi - a Greenfield coal-fired Power Plant built by ESKOM near Lephalale in the Limpopo province, South Africa. The plant has a construction value of R 120 Billion - When complete, the power station will comprise six units with a gross nominal capacity of 800 MW each, resulting in a total capacity of 4800 MW of power.

Assignment: Representing JR Knowles I provided support and advice to the Engineer’s representative on contractors’ claims.
Post Award Responsibilities:

Assignment: Representing Fluor and Maaden’s interests at all levels for Maaden-Alcoa, I directed the commercial aspects of contract tender evaluation; Procurement and award recommendation, led contract variations to resolution; monitored contracts execution.
